Digital Millennium Copyright Act Policy

Welcome to (the ‘Site’). We value the intellectual property rights of others just as we expect others to value ours. In accordance with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their representative can submit a takedown notice to us through our DMCA Agent as listed below. As an internet service provider, we are eligible for immunity from infringement claims under the “safe harbor” provisions of the DMCA. To submit a good faith infringement claim to us, you must provide a notice containing the following information:

Notice of Infringement – Claim

  1. A signature of the copyright owner or an authorized person;
  2. Identification of the copyrighted work alleged to have been infringed;
  3. Identification of the infringing material to be removed, and details to help locate it;
  4. Contact information for the complaining party;
  5. A statement asserting that the use of the material is unauthorized by the copyright agent;
  6. A statement affirming the accuracy of the notification and the authority of the complaining party.

Section 17 USC §512(f) imposes civil damage penalties against those who knowingly misrepresent information in a notification of infringement under 17 USC §512(c)(3).

Note that we may disclose the identity and information in any copyright infringement claim to the alleged infringer. By submitting a claim, you consent to your identity and claim being communicated to the alleged infringer.

Counter Notification – Restoration of Material

If you have received a notice of material being taken down due to a copyright infringement claim, you may send us a counter notification to request the restoration of the material. The notification must be in writing to our DMCA Agent and include the following elements as per 17 USC Section 512(g)(3):

  1. Your signature.
  2. A description of the material taken down and its original location.
  3. A statement under penalty of perjury that the material was removed by mistake or misidentification.
  4. Your name, address, telephone number, and a consent statement for the jurisdiction of the federal district court.

Repeat Infringer Policy

We treat copyright infringement seriously. We adhere to the repeat infringer policy obligations of the Digital Millennium Copyright Act by maintaining a list of DMCA notices and making efforts to identify repeat infringers. Any violators of our internal policy will face account termination.
